Businessman Kalungi ordered off Uganda Railways' land

KAMPALA – The Land Division of the High Court in Kampala issued a temporary injunction, halting construction of a commercial building allegedly owned by businessman Moses Kalungi on land contested with Uganda Railways Corporation (URC).

The injunction dated May 13, 2025, was issued by the same court’s registrar, Rashidah Batanula.

“A temporary injunction doth issue restraining the respondent, her servants, employees, assignees, agents and or successors in the tittle from further alienating, transferring, wasting, constructing, excavating, selling, and or entering into any part of the suit land comprised in FRV440 FOLIO 29 Plot 54-51 Nasser Road measuring approximately 0.51 acres, land at Nasser road and carrying on activities whatsoever on suit land until the disposal of the final suit pending before the Honourable Court.”   

The injunction arises from a suit filed by URC after it determined through boundary opening that the businessman had encroached 18 meters into its land.

Background

In December last year, Kalungi allegedly commenced excavation on land situated on plot 43 and 41 along Nassar road in Kampala in preparations for the construction of a commercial building. 

URC Officials, on realising that the businessman had encroached on its land, brought the matter to him and advised that boundary opening be undertaken before further construction. 

This was disregarded, and construction commenced. However, URC claims it has repeatedly faced illegal encroachment on its land. 

Reports from URC further reveal that over 20,000 people are scheduled for compensation along the Kampala – Malaba – Kyengera – Portbell railway reserve to give way for railway development programmes. 

The said people are reported to have settled on the said land without authorisation.
