Nabukenya retains Luwero Woman MP seat as court dismisses petition

In a judgment delivered electronically through the Electronic Court Case Management Information System (ECCMIS) on Friday, Justice Vincent Emmy Mugabo ruled that Kirabo failed to provide sufficient evidence to support her claims that the votes had been miscounted or that she had actually won the January 15, 2026, election.

The High Court in Luwero District has upheld the election of Brenda Nabukenya as the Luwero woman MP. This decision comes after the court dismissed a petition filed by her rival, National Resistance Movement’s (NRM) Agnes Kirabo Nantongo.

Kirabo, the runner-up in the race for the Luwero MP seat, filed a lawsuit against Nabukenya and the Electoral Commission. She alleged discrepancies in the vote tallying, along with instances of fraud and irregularities in the declaration of the results.

According to the official results, Nabukenya received 67,399 votes, while Kirabo garnered 55,696 votes.

The other candidates in the race included independent candidate Mariam Nakiganda, who received 2,926 votes, and Moureen Nakuya from the Democratic Front (DF), who came in last with 2,364 votes.

Kirabo, in her petition, claimed that there was evidence of fraudulent activity regarding the results from specific declaration forms, where the results reported did not match the physical declaration forms.

However, Justice Mugabo ruled that Kirabo failed to meet the burden of proof required, which must be established on a balance of probabilities as outlined in Section 80(3).
