IGANGA — Iganga court has issued a criminal summons against Ibrahim Musasizi, a man accused of demolishing the houses of a 70-year-old widow before he allegedly forcefully took over her family's 16 acres of land in Namutumba district.

The summons was issued mid-week by the Grade One Magistrate Ali Tibenkana after Musasizi failed to appear in court for the hearing of the case.

The accused allegedly committed the offence of malicious damage to property when he suddenly emerged and claimed ownership of the land in July last year.

Local reports indicate that the widow Mariam Mutesi Tabisa and her family had lived for over 43 years before the death of her husband, Amis Mpanga.

State attorney Arap Malingha asked the magistrate to issue the summons and warrant arrest after Musasizi failed to turn up when the widow and other witnesses were ready to testify against him.

Martha Among told the court that her husband (Musasizi ) skipped court due to ill health.

But Malingha challenged the medical documents, citing an attempt to evade the speedy trial of the case for the family to get justice.

The magistrate Tibenkana consequently issued criminal summons against him and other accomplices who too failed to turn up.

Tibenkana later adjourned the matter to November 11, when the accused will turn up for hearing of the case and warned that arrest warrants would be issued if they totally fail to turn up.

Damalie Nyafono, a legal officer with Redeem International which advocates for the rights of widows and orphans who assisting the family with free legal services welcomed the issuance of the criminal summons that will help to speed up the matter.
