Court orders KCCA to pay woman sh100m over stalled deployment

The Supreme Court has ordered Kampala Capital City Authority (KCCA) to pay Doreen Tusiime sh100 million in general damages, ruling that the authority unlawfully frustrated her appointment by repeatedly delaying and eventually halting her deployment.
In a judgment dated July 31, 2026, a panel of five justices led by Catherine Bamugemereire declared that KCCA acted unlawfully by failing to deploy Tusiime despite formally notifying her of her appointment.
Other justices on the panel are Percy Tuhaise, Elizabeth Musoke, Christopher Madrama and Muzamiru Mutangula Kibeedi.
“Tusiime’s appointment is valid, and the authority’s failure to deploy her was unlawful,” Bamugemereire ruled.
The justices further ruled that Tusiime's sh100 million award will attract court interest at a rate of 6%.
However, the court declined to award Tusiime salary and other employment benefits, noting that she had never assumed office.
“To award salary or allowances for a period in which no service was rendered would amount to unjust enrichment and would contradict the principle that remuneration flows from service,” Justice Bamugemereire observed.
The justices further ruled that Tusiime's sh100 million award will attract court interest at a rate of 6%.
However, the court declined to award Tusiime salary and other employment benefits, noting that she had never assumed office.
“To award salary or allowances for a period in which no service was rendered would amount to unjust enrichment and would contradict the principle that remuneration flows from service,” Justice Bamugemereire observed.
The justices ruled that the Court of Appeal erred in law by finding that Tusiime's judicial review application was time-barred and set aside the decision.
“The cause of action in this matter arose from continuing administrative acts of the authority, which directly affected the applicant’s rights. In law, where an illegality or breach is ongoing, limitation does not run in the same manner as for completed transactions,” Bamugemereire noted.
Court records show that after receiving her appointment letter on October 1, 2012, Tusiime was instructed to report to KCCA's executive director for deployment.
However, when she reported, the director of human resources verbally informed her that the deployment had been suspended due to a lack of funds and advised her to wait until the next financial year. The same explanation was given during the 2013/2014 and 2014/2015 financial years.
On October 6, 2016, the authority formally informed Tusiime that her deployment had been halted indefinitely because of persistent financial constraints.
“The cause of action in this matter arose from continuing administrative acts of the authority, which directly affected the applicant’s rights. In law, where an illegality or breach is ongoing, limitation does not run in the same manner as for completed transactions,” Bamugemereire noted.
