KAMPALA Capital City Authority (KCCA) has repossessed land and property formally occupied by Subway Restaurant located in the intersection between Crested Towers and Uganda Broadcasting Corporation (UBC) on Nile Avenue in Kampala.
According to the KCCA deputy spokesperson, Robert Kalumba, there is a restaurant, a bar and other businesses operated by a Chinese lady and other tenants on the land measuring 0.158 acres.
The Chinese business woman, he explained, had let out some of the structures to tenants.
In the August 11, 2014 letter that was addressed to lawyers of the landlord, the KCCA legal affairs director, Mike Okua, said there was no evidence to show that she acquired the property through a formal bidding process as required by the Public Procurement and Disposal of Public Assets Act of 2003.
He also noted that there was no evidence of an existing tenancy agreement between the land lady and the tender board of the defunct Kampala City Council.

Okua also explained that there is a recent High Court order which declared that the contract between Kampala City Council and Equator Touring Services was declared illegal due the absence of a tenancy contract awarded by the then Kampala district tender board.
“Your client’s continued occupation and possession of the facility and premises at Subway is without legal basis. Prevail upon your client to vacate the said premises not later than August 31,” the letter read in part.
Kalumba said the ‘landlady’ has left the premises.
“Her tenants are still around but they have been informed that KCCA would retake its property on Monday and they are planning to leave.”
He said KCCA would determine how to put the land and the structures to use after taking over.
