Court sends killer to the gallows

JUSTICE Benjamin Kabiito of the High Court has sentenced to death, Peter Mukisa, a casual labourer, who beheaded a workmate on suspicion of taking over his job.

“I find no justification for this most senseless murder. It was intentional, deliberate, most foul and brutal, for which there is only one sentence to justify its ends and; that is death,” the judge said.

Mukisa, 42, had been indicted for the murder of Julius Kakeeto, 34, who was alleged to have taken over Mukisa’s job of looking after property, including land, that belonged to the parish chief of Upper Kkonge in Makindye Division.

Kabiito also agreed with the state attorney that the convict exhibited the most abhorring wickedness by decapitating the victim’s head even after he had already killed him by hitting him on the head with a block.

“The evidence of the ten witnesses was corroborative enough to leave no doubt that the convict willingly and maliciously carried out the murder. Although he tried to retract his confession, the court found that he willingly made it before the Police,” Kabiito said.

According to Mukisa’s charge and caution statement to the Police, which he later denied, he decapitated his victim’s head and buried the torso in a pit. He put the head in a black polythene bag which he took to a witchdoctor for cleansing before he could bury.

However, the witchdoctor raised an alarm and the residents arrested Mukisa as he tried to flee from them.

It was alleged that on December 24, 2006 Kakeeto had arranged to travel to his home village in Masaka for Christmas. However, he was advised to first clean the house he was supposed to live in on his return as he takes over a new job. It was behind this house that his torso was buried.

Mukisa tricked Kakeeto that he would help him to clean his house. As they arrived at his would be residence, Mukisa hit Kakeeto on the head with a huge block, killing him instantly, according to the prosecution.
