THE Commercial Court yesterday ordered Kampala tycoon Hassan Basajjabalaba to respond to an application demanding him to deposit sh800m in court as security of a pending case, reports Jude Etyang.

The registrar of the court, Precious Ngabirano, ordered that by Tuesday, Basajjabalaba should respond to the application filed by a Hong Kong company, Arzignano Leather company, which is
claiming the debt.

Arzignano, represented by Christopher Madrama and David Sempala, asked the court in vain to entertain the application without hearing Basajjabalaba’s side.

The application seeks either a cash deposit of sh824,649,880 or seizure of Basajjabalaba Hides and Skins factory as security until the case is concluded.

Basajjabalaba’s lawyer, Obed Mwebesa, successfully opposed Arzignano’s pleas saying, “It’s against the rules of natural justice that a party should be condemned unheard.” Ngabirano agreed it would be unfair not to hear Basajjabalaba’s side.
