Court rejects CAO’s plea

THE High Court has rejected a plea by the interdicted Mbale Town Clerk Fred Gyabi Bukeni in which he sought to restrain Mbale municipal council from compelling him to hand over office.

THE High Court has rejected a plea by the interdicted Mbale Town Clerk Fred Gyabi Bukeni in which he sought to restrain Mbale municipal council from compelling him to hand over office.

Mbale High Court registrar P. W. Gadenya, in his ruling said compelling the municipal council to keep Bukeni in office when the internal dynamics in the council were volatile might not augur well for Bukeni and the municipal council.

Bukeni, through his lawyer Samuel Wegoye and company advocates asked court to issue an interim order stopping the council from compelling him to hand over office.

Wegoye said the council was acting in contravention of the law.

On October 23, the council passed a resolution to suspend Bukeni from the office for alleged incompetence, abuse of office and misconduct.

The suspension prompted the District Service Commission to interdict Bukeni on November 27 and directed him to hand over office. Bukeni’s suspension was backed by a letter from the Solicitor General L. Tibaruha.
