KAMPALA - The Buganda Road Court Principal Grade One Magistrate, Robert Mukanza, has dismissed an application filed by former Buyende district Police commander (DPC) Muhammad Kirumira, seeking unconditionally release.
On Thursday, Mukanza agreed with the court's resident state attorney, Jonathan Muwaganya that Kirumira was legally before the Police tribunal and he had no jurisdiction concerning his trial and confinement.
On February 2, Kirumira through his lawyers, dragged the Attorney General to the court seeking to be unconditionally released from jail on grounds that his detention is unconstitutional, illegal and unlawful.
But before the application was heard on Wednesday, Muwaganya raised a preliminary objection, saying the Magistrate's courts have no powers to hear it.
