Sejusa ceased to be a UPDF officer - Court rules

The High Court in Kampala has ruled that the former coordinator of Intelligence Services, Gen David Sejusa alias Tinyefuza, is no longer a serving officer.

In her ruling, the presiding Judge, Margret Oguli-Oumo stated that she is compelled to find that Sejusa is entitled to a remedy of 'constructive discharge' termed as legally being retired from Uganda Peoples Defence Forces (UPDF).

The court also awarded Sejusa sh750m in compensation, saying he is a senior citizen who has spent all his life in service working as a police and army officer and injured during the liberation war.

The Judge added that Sejusa has dependents to look after an yet he has not been receiving his salary and other benefits.

Gen.  Sejusa dragged the AG to court, seeking a declaration that he ceased to be an officer of the UPDF on April 8, 2015, since 90 days within which the army ought to have communicated its decision to him had expired.

Sejusa further explains that UPDF's refusal to pay his salary, withdrawal of his uniforms, housing and transport allowances and guns among others benefits amount to 'constructive discharge'; which he termed as legally being retired from the army.
