TikToker charged over alleged fake news, data disclosure

The Buganda Road Chief Magistrates’ Court has charged a TikToker with unlawfully obtaining and disclosing personal data and publishing fake news.

Aziz Tarik Nkata, 41, a resident of Makindye Division, Kampala, appeared before Principal Magistrate Rophine Achayo on October 6, 2026, and denied the charges.

Nkata is accused of unlawfully obtaining and disclosing personal data, contrary to Section 35(1) and (2) of the Data Protection and Privacy Act, Cap 27.

The prosecution alleges that in July 2026, in Kampala and Wakiso districts or thereabouts, Nkata and others still at large, through the TikTok account @Mr. Accountability, unlawfully obtained and disclosed personal data, namely a photograph of Nathan Bwogi, without his prior consent.

He is also charged with publishing fake news, contrary to Regulation 110(e) of the Uganda Communications (Licensing) Regulations, 2019.

The prosecution alleges that during the same month and in the same areas, Nkata and others still at large, through the TikTok account @Mr. Accountability, published an audio-visual news story claiming that Bwogi used guns to evict people from their land, whereas this was not the case.

The charge sheet states that the TikTok account was accessed through Airtel Uganda Limited’s communication platform using Subscriber Identity Module (SIM) card number 0700-947458.

Background

Bwogi, an employee of State House, told journalists that he handles land-related matters that come before President Yoweri Museveni.

Bwogi said his work involves handling land complaints and ensuring that parties to disputes are given an opportunity to present their respective sides before a matter is considered.

He alleged that Nkata obtained his personal data without his consent in July and subsequently used it to publish what he described as fake news about him.

He added that Nkata’s family members and colleagues had approached him seeking forgiveness for the TikToker.

Bwogi said he was prepared not to oppose the request for Nkata to be released, but that the matter could not proceed as anticipated in court.

State Attorney Dianne Hope told court that investigations had been completed and asked for a hearing date.

Magistrate Achayo adjourned the case to October 19, 2026, for hearing.
