The High Court Civil Division has thrown out the evidence presented by the Attorney General and the Police challenging allegations by the Mityana municipality Mp Francis Butebi Zaake that he was tortured for defying presidential directives on COVID-19 during the lockdown.
This was today when the case came up for hearing before Lady Justice Esta Nambayo.
The thrown out evidence was in the form of an affidavit by Moses Mugisha from the office of the Attorney General in which he was opposing all torture allegations brought forward by Zaake.
This was after lawyer Johnson Natuhwera who represented the Attorney General informed court that he won't be able to produce Mugisha in court for cross-examination as requested by Zaake's lawyer Eron Kiiza.
Zaake dragged government to court seeking compensation for alleged tourture he says was meted out to him by police officers.
He is specifically accusing Abel Kandinho, the head of CMI, Bob Kagarura, the Wamala Regional Police Commander, Alex Mwine, the Mityana District Police Commander, Elly Womonya, the Commandant Special Investigations Unit Kireka, Musa Walugembe, Hamdan Twesige, and Haruna Mulungi.
Zaake alleges that he was arrested on April 19, 2020, at his home in Buswabulongo village and beaten while accusing him of defying presidential directives by giving out food during the lockdown period.
He says he was kicked, slapped, and sprayed with unknown substances in the eyes which affected his eyesight.
Zaake came to court walking with the help of crutches. He now wants the government to compensate him for the damages caused.
The hearing has been adjourned to September 29, 2020.
