Kiboga gang robbers charged, remanded to military prison

Prosecution contends that Tamale and Ngobi on December 12, 2018 at Kikuubo village, Bukonero Town Council in Kiboga district robbed sh37m from Asuman Mayanja

MURDER   COURT        ROBBERY 
 
KIBOGA- The General Court Martial (GCM) in Makindye on Tuesday charged and remanded two men for armed robbery and murder.
 
The charged were Godfrey Tamale, 42, a businessman and Hassan Ngobi Sebakaki, 39 a boda boda cyclist, all residents of Nansana Municipality in Wakiso district.
 
Lt. Gen. Andrew Gutti, the chairman GCM read them the charges of which they denied.
 
They were charged with aggravated robbery and murder. The offences are contrary to sections 188, 189, 285, and 286 (2) of the Penal Code Act Cap 120.
 
According to prosecution, Tamale and Ngobi are subject to military law by virtue of section 119 (1) (h) (I) of the UPDF Act, 2005 and the offences carry a maximum penalty of death on conviction.
 
The prosecution contends that Tamale and Ngobi on December 12, 2018, at Kikuubo village, Bukonero Town Council in Kiboga  district robbed sh37m from  Asuman Mayanja .
 
Prosecution adds that during the said robbery before or immediately, the duo was in unlawful possession of a deadly weapon  SMG S/NO.56-36066880, the said gun being ordinarily a monopoly of the Defence Forces.
 
It was further alleged that the accused, using the same gun killed Ashraf Atugonza of Kijojolo village in the same district.
 
Preliminary investigations revealed that Atugonza one of the robbers was shot dead by his accomplices as they fled the scene.
 
Prosecution led by Maj. Rapheal Mugisha told court that after the alleged robbery, two of the four robbers had since died.
 
"My Lord and the entire board members, investigations reveal that after the robbery, misunderstandings arose and one of the accused, whom we are yet to identify, shot Atugonza dead as they were on the run.
 
The defence lawyer, Maj. Charles Ssekayita didn't object to the prosecution prayer of an adjournment.
 
The case was adjourned to June 17, 2019.
