Kitagwenda MP fraud case adjourned to May

KAMPALA - The Buganda Road Chief Magistrate's Court has adjourned the case in which Kitagwenda Member of Parliament Abbas Agaba is charged with fraud to May 15.

This was after Agaba's lawyer Kenneth Kakande informed the court that his client was out of the country on official duties.

"Your honour, my client is in Morocco on parliamentary duties of this state. But it is not deliberate that he has skipped court because he is a law a binding citizen of this mighty country," Kakande submitted.

Prosecution led by Charlotte Kwikiriza did not object to Kakande's submission, prompting the Chief Magistrate, Miriam Ayo Okello to adjourn the matter.

"Since the prosecution and defense have all agreed for an adjournment, I hereby adjourn this matter to May 15, 2019," Okello ruled.

Agaba, 39, who is currently on sh2m cash bail, is accused of fraudulently obtaining sh110m.

He is battling with six counts of obtaining money by false pretense contrary to section 305 of the Penal Code Act.

If convicted, Agaba will face a maximum imprisonment sentence of five years in jail.

The prosecution contends that on August 12, 2016, at Lugogo House 42 bypass in Kampala, Agaba, and others still at large, with intent to defraud, obtained to wit sh30m from  George Patrick Kasajja, purporting that he was going to represent him as an advocate whereas not.

It is further alleged that in November, at the same place and year, Agaba also fraudulently obtained sh20m from Kasajja.

The prosecution further alleges that in December, at the same place and year, the accused falsely obtained sh20m.

It is also alleged that on February 27, 2017, Agaba fraudulently obtained sh20m and on June 2 at Café Mocca along Dewinton road obtained sh10m and sh10m on June 5 all purporting to represent Kasajja in court whereas not.
