The peacetalks between Brian Bagyenda and the Director of Public Prosecution,  that had been scheduled for Monday with a view of reaching a  consensus over the  murder of  his girlfriend Enid Twijukye in exchange for a lighter sentence, have failed.

A Senior State Attorney Joseph Kyomuhendo, says there is no way DPP can proceed  with what Bagyenda wants, yet his lawyer Nsubuga Mubiru is saying that his client is insane, having escaped from Butabika Hospital where he was a patient prior to  Committing the alleged offence.

However, Kyomuhendo mantains that Bagyenda and his co-accused were examined on Police Form 24, and found to be of sound mind and able to stand trial.

It is against this background that High Court Judge Anthony Ojok Ayu adjourned the matter to 14th,January, 2019.
He has instead advised the accused persons to choose the Plea bargain Process; as a solution since the two wrongs do not make right.

Having been  under the influence of mental illness as the defence lawyer alleges, then the Court is likely to come in to resolve the matter between both Parties and the relatives of the victim, if the plea bargain fails for good.

Meanwhile, the judge ordered the prosecution  to avail the defence team with all the necessary evidence and exhibits  to enable the accused persons also prepare their defence.
