KAMPALA - The Court of Appeal has overtuned the decision by the Jinja High Court to throw out Peter Mugema Panadol out of Parliament.
On Thursday morning, the Court of Appeal ruled that rightful MP for Iganga Municipality seat is Panadol and not Abed Nasser Mudiobole, his long-time rival, as Jinja High Court had declared.
In June 2016, Panadol ran to the Court of Appeal to challenge the rulling by Jinja High Court, which stated that he had been illegally elected in the February 2016 polls.
The High Court in Jinja had revoked the declaration of Mugema as MP for Iganga Municipality and declared that Mudiobole of the opposition Forum for Democratic Change party was the rightful MP elect of the constituency.
The decision to declare Mdiobole winner was reached after considering that a byeelection would cost the Electoral Commission and waste the taxpayer's money.
It is this decision that made panadol restless and he run to Court of Appeal to save his seat.
Mudiobole had filed a petition, saying the election had been marred with irregularities, including bribery and ballot stuffing.
