Court confirms Ngabirano Rwampara MP

Kyamadidi had accused Ngabirano of violence and intimidation during campaigns, ballot stuffing and unsigned declaration forms.
The Court of Appeal has confirmed Charles Ngabirano as the validly elected Member of Parliament for Rwampara County.
This was after a panel of three Justices led by the former Deputy chief Justice Steven Kavuma ruled that Vicente Kyamadidi failed to prove to the satisfaction of court allegations of non-compliance in the conduct of the election against Ngabirano.
Kyamadidi had accused Ngabirano of violence and intimidation during campaigns, ballot stuffing and unsigned declaration forms.
Kyamadidi was dissatisfied with the results and filed a petition contending that Ngabirano was not the validly elected MP for Rwampara citing non-compliance with the elections Act.
Kavuma who was assisted by justices Elizabeth Musoke and Cheborion Barishaki also ruled that the trial Judge Winifred Nabisinde properly applied the required standard and burden in evaluation of the case.
The appeal was dismissed and Kyamadidi ordered to bear the costs of the appeal and the trial court.
On February 2016, Kyamadidi and Ngabirano were among the five candidates who contested for the parliamentary seat of Rwampara constituency in Mbarara district.
Electoral Commission declared and gazzetted Ngabirano, winner of the said election with 25,289 votes against Kyamadidi who polled 21,607 votes.
