Guvnor Club Murder: Kamyuka's Police file goes missing

The defendant in a dramatic court session disowned his lawyer

The trial of city businessman, Ivan Kamyuka, accused of stabbing to death John Ahimbisibwe in Club Guvnor, failed to kick-off after the State disclosed to court that his Police file is missing.

On Tuesday State Prosecutor, Brian Kalinaki, told court presided over by Justice Wilson Kwesiga that the accused's Police file is still being traced at Nakawa Chief Magistrate's Court, where he was charged last year.

"I have no Police file but I will make sure get it before tomorrow so that I peruse through it," he assured court.

Kamyuka, 34, a human resource manager of Lake Bounty Ltd, a fish processing and exporting company, was supposed to plead to a murder charge.  

Kamyuka is battling the charges contrary to Section 188 and 124 of the Penal Code Act (PCA). Anyone charged with murder is liable to a non-mandatory death sentence on conviction.

Kamyuka who is currently out on a sh5m cash bail reports to the deputy registrar twice in a month, as a fulfilment of his bail condition.

The accused disowned lawyer Sylvia Namawejje, who was instructed by the State to represent him, saying he will get a private lawyer within two weeks.

"I have never been represented in court but I will get a private lawyer," Kamyuka said.

This prompted the Judge to peruse through court documents, only to discover that Kamyuka was earlier represented in court by Julius Galisonga and Ivan Mugabi.

"Telling lies at the beginning of the case might haunt you during the course of the trial. It is very bad," the Judge warned.

On September 11, 2015, Kamyuka was committed to the High Court for trial by Nakawa Grade One Magistrate, Christine Nantege, after prosecutor Joyce Anyango informed her that the Directorate of Public Prosecutions' investigation into the suspect's case is complete.

Anyango further told court that the State has enough evidence including Kamyuka's charge and caution statement, in which he admitted confronting Ahimbisibwe, and injured him.

According to the charge sheet, Kamyuka, a resident of Kisaasi-Kyanja in Nakawa division, is accused of fatally stabbing Ahimbisibwe on August 2, 2015 in Guvnor on First Street, Industrial Area in Kampala.

Prosecution alleges that Kamyuka hit Ahimbisibwe with a broken glass after he came out of the club toilets and found that he had hit his wife Nina Nyarwaka.

Ahimbisibwe was moments later rushed to Case Medical Centre in Kampala, where he was pronounced dead upon arrival

The case has been adjourned to June 3, for hearing.
