Judge dragged to court over alleged land fraud

The Mbarara High Court resident judge, Duncan Gaswaga, has been dragged before the Land Division by a one Henry Nsubuga for allegedly stealing 23 decimals of land in Muyenga.

Nsubuga alleges he bought his 23 decimals from a one Lucy Nsubuga in 2005, who informed him that she gave the land title to Gaswaga to transfer his 22 decimals he had bought from her.

The judge however transferred all the land including Nsubuga's 23 decimals into his name.

The land in contention measuring 45 decimals is located on Block 872 Kyeyitabya in Bukasa-Muyenga.

Nsubuga now wants court to order Gaswaga to hand over the land title so that he transfers it into his names and issue an order restraining Gaswaga from trespassing on his land.

Gaswaga has however also asked court to order his accuser deposit sh90m in court as security, saying his suit has no chances of success and he has no known place of residence where he can be found in case his case is dismissed and ordered to compensate him.
