Judge dragged to court over land deal

International Crimes Division Judge Elizabeth Nahamya together with her husband Dr. Sam Nahamya have been dragged to court for allegedly failing to pay over sh120m being balance of a land purchase they made four years ago.

Galton Fenzi contends that the couple in August 2012 entered into a sale agreement with his late mother Natasha Marie Nabbosa for land on block 244 and plot 7596 in the city suburb of Kisugu at sh750m which they had to pay in two instalments.

Fenzi claims that the couple paid sh630m, leaving a balance of sh120m which they have refused to pay to date despite repeated demands even though they occupy the said premises.

He avers that the conduct of the couple amounts to a breach of contract to which he demands general damages.

The case has been allocated to Justice Monica Mugenyi, the Commercial Court Judge.

The Commercial Court registrar, Thaddeus Opeseni has summoned Justice Nahamya and her husband to respond to these claims within 15 days.

The register warned that if he does not reply to the allegations, judgment will be delivered in her absentia.
