A supply company has sued Uchumi Supermarkets over uncleared debt to the tune of sh63.4m. The firm, 7 Days International Limited, deals in sanitary products

A supply company has sued Uchumi Supermarkets over uncleared debt to the tune of sh63.4m. The firm, 7 Days International Limited, deals in sanitary products.

 

It alleges that it supplied goods to Uchumi Supermarkets worth sh63.4m from February 2011.

 

‘’Should you fail to file a defence on or before December 4, the plaintiff may proceed with suit and judgment may be given in your absence,’’ the court ordered.

 

The company claims in the document, contends that the defendant’s acts constitute breach of supplies contract between it and the defendant.

 

The company further contends that because of the defendant’s acts, it has suffered financial loss and inconvenience, for which general damages from the defendant will be claimed.

 

The court document states that an order for payment of the said money, being money owed to the company by the defendant, interest on general damages, costs of suit should be paid at the rate of 28% per annum from the date of breach, 2013, till payment in full.
