Dr. Kiyingi loses properties

Police had a run battle with Alerts security guard on Thursday as they forcefully evicted the relatives of Australia based cardiologist, Dr. Aggrey Kiyingi from their palatial house in Buziga, Kampala.

The guards fired as police and Spear Link Auctioneers led by Moses Kirunda, tried to seize the house. Regional Police Commander, Kampala South, James Ruhwezi beefed up more policemen and managed to enter the gate and handed the keys to the court bailiffs.

Police arrested the guards and took them to Kabalagala Police station. The scuffle follows a case in which the High Court in Kampala ordered for the disposal of and attachment of six properties of Dr. Aggrey Kiyingi due to failure to pay Sh4.7b debt.  

Kiyingi was sued by one Jackline Diana Asiimwe in 2008 for failing to pay Shs70m after she allegedly supplied him with 1750 bags of white Cement.

Court heard that Asiimwe allegedly supplied Dr. Kiyingi of Dehezi International with 1,750 bags of white cement worth Shs70m on whose payment he defaulted on October, 16, 2006.

Through his lawyers of lex Associates, Kiyingi protested the sale of his properties saying that the complaint who dragged him to court was non-existent.

Dr. Kiyingi reported a case of forgery, uttering a false document and demanding money at Central Police Station Kampala in 2009 prompting police to issue repeated summons for Asiimwe through her lawyers of Serwanga, Maiteki and Company Advocates.

Despite Kiyingi’s protests and Police’s repeated pointing out that Jackline Diana Asiimwe did not exist, the High court went ahead to attach and sell to recover the money.

The lawyers said that the samples of Dr Aggrey Kiyingi signature were all taken by the government forensic examiner and it was proved that his signature was forged.

According to his lawyers, properties that are lined up to be disposed include six pieces of land, three of which are in Buziga.

They are Plot 48, Block 273, Plot 141/142 Block 273 and Plot 35 Block 273. There are also other pieces of land in Namulonge on Plot 18, Block 158, Plot 23, Block 158B, Plot 25 Block 158B and Plot 27 Block 158B.

One piece of land on Buziga hill has been sold to Amdan Khan of Kasese for Sh2.2b as per the sale agreement document.

However Freddie  Egesa who has powers of Attorney for Dr. Kiyingi’s properties maintains that Asiimwe is non-existent and they have already appealed to higher courts of laws.
