THE interdicted director of physical planning, Kampala Capital City Authority, George Ninsiima Agaba was Thursday granted bail. He faces murder charges.
Agaba was granted bail by Nakawa High Court Judge Faith Mwondha on grounds that he is suffering from a stiff back and a slipped spine disc, resulting from the motor accident. He has spent close to two months in Prison.
The defense lawyer Grace Nuwamanya of Kahara and Company Advocates said the applicant's illness which has aggravated from the traffic accident, is not responding to the treatment offered. "The available treatment in prison cannot handle his illness," he said.
"I grant the applicant bail and he will be reporting after every fortnight to the Chief Magistrate in Nakawa Court to extend his bail," Mwondha said, despite an objection by State Attorney Michael Mukwana. He argued that the alleged grave illness had not been satisfactorily proved.
Agaba is jointly charged with his bodyguard Santos Komakech with murder resulting from a shooting incident during a botched eviction exercise in Port Bell in Luzira, a Kampala suburb. John Onyango was shot dead while Florence Nalwadda and Akim Kakumba sustained gunshot wounds when Komakech allegedly opened fire into residents as they resisted an attempt to evict them from the area by KCCA enforcement officers.
