A long-standing dispute involving a plot of prime land in Kampala belonging to the relatives of former President Yusuf Lule has been settled out of court.
The land is estimated to be worth billions of shillings.
According to the consent judgment, the land located on Namirembe Road, overlooking Nakivubo Stadium, will now be transferred into the name of the initial buyer, Mugerwa Mugalaasi.
The High Court endorsed the consent settlement.
Kasirye, Byaruhanga and Company Advocates were compelled to reimburse sh724m to Ephraim Ntaganda, to whom they had allegedly sold the land.
According to the court records, Ntaganda paid the money to the law firm, purporting to have bought the land from one of late Lule’s children.
The consent order followed a suit in which Mugalaasi had sued four of Lule’s children – Ntwatwa Lule, Fred Lule, Kibalama Kato and Norah Lule – as well as Kasirye and Byaruhanga’s law firm.
Mugalaasi said he was a bona fide purchaser of the land and tried to get its title transferred into his names. He had complained that the land had been wrongfully sold to Ntaganda because he had already paid in full for the property.
“Kasirye, Byaruhanga and Company Advocates shall transfer to Ntaganda sh724m, which he paid into the law firm’s bank account as consideration for the purchase of the land,†the consent order reads.
“Ntaganda is also compelled to withdraw all the caveats he had lodged upon all the properties and surrender to Mugalaasi, as the rightful owner of the suit land, the certificates of title.â€
