Maj. Rwaboni in court over sh279m debt

RETIRED Maj. Okwiri Rabwoni, brother to the late Brig. Noble Mayombo has been dragged to court for failure to pay over sh279m to a car tyre trading company.

Sameer Africa Ltd, dragged Rabwoni to the commercial court with his wife, Solange Ingabire, and Martin Rwakibare for failure to pay the money after they were sold an assortment of car tyres.

According to a suit filed last year, Sameer sold tyres on credit to Soval International, a trading company, between 2007 and 2008.

The defendants, who are also directors of Soval International, were last year ordered through the High Court to pay the money within six months after the two parties entered a consent judgment.

However, the money was never paid after a series of post-dated cheques from Stanbic Bank to effect payment were dishonoured by Sameer’s bankers, Standard Chartered Bank last year.

This was after it was detected that Soval International had insufficient funds on its account.

Sameer has since filed an application seeking for the defendants to pay the money.

“Counsel for the applicant shall move the court for seeking orders that the directors of Soval International, the judgment debtor, be ordered to jointly pay sh279m to the applicant,” the notice of application said.

In the application, Sameer argued that it detected fraudulent dealings on the side of Soval International, saying it had never filed returns of valuation reflecting its assets its with the registrar of companies.

The hearing was scheduled for Monday by Justice Arach Amoko but she was indisposed. Rabwoni and Solange were present in the court. Hearing was adjourned to April 1.
