Govt to pay Rwanyarare sh3b for land

THE High Court in Mbarara has ordered the Government to pay sh2.9b in compensation to the former chairman of the Uganda people’s congress presidential policy commission, Dr. James Rwanyarare.
The Attorney General (AG) and 23 others lost the case in which the Government was accused of forcefully acquiring Rwanyarare’s 800 hectares of land on Ankole ranching scheme.
The case was filed by Rwanyarare in 2001 against the Government for using the land without his consent.
Rwanyarare’s lawyer Ngaruye Ruhindi told court that in 1990, NRM soldiers and the defence unit personnel entered the ranch, destroyed the fences and resettled there 23 herdsmen from Luwero in 1990. The land is situated in Kayonza village in Kiruhura district.
Justice Lawrence Gidudu on Monday ordered the Government to pay sh1.7b to Rwanyarare for special damages and sh1.2b for general damages.
“The Court has found that the Government forcefully trespassed and settled herdsmen on Rwanyarare’s land, and destroyed the eucalyptus forests, fences, diptanks, valleydams, structures and farm equipments. The court, has, therefore, ordered for the payment of general damages and compensation from 2001 when the complainant lodged the case,†the statement read.
The AG was also ordered to pay Rwanyarare about sh5m for the loss of 878 exotic livestock.
Rwanyarare, who was in India for heart treatment when the judgment was read, bought the land in 1975.
