THE High Court in Mbarara has ordered Pidson Wavamunno to pay sh40m in damages to his elder brother and Kampala tycoon, Gordon Wavamunno.
The court, presided over by Justice Lawrence Gidudu, on Thursday ordered Pidson to pay the money after he lost a land case.
The two brothers have been fighting over 70 plots of land in Nkokonjeru and Kamukuzi. Gordon sued his brother for trying to steal his land, claiming Pidson stopped him from selling it by putting a caveat on the titles.
Pidson told the court that he got the plots of land from Gordon in exchange for his shares in Spear Motors.
He claimed that he joined Gordon and their two late brothers in a business partnership of Spear Motors, Lake View Hotel and Wavah Holdings in the 1960s, but parted ways in 1993.
Pidson said Gordon gave him the land but later turned against him. Gordon’s lawyer, Chris Bwanika, asked the court to dismiss Pidson’s claims, saying he was given part of his shares, including vehicles and land.
Pidson’s lawyer Kenneth Kakuru was not present in court when the ruling was made. Passing the judgment, Gidudu ordered Pidson to pay sh40m for denying Gordon the right to use his property, knowing that he was paid for his shares.
Pidson said he was dissatisfied with the judgment and would appeal against it. He claimed that the judgment was biased, saying it was supposed to be read on March 31, but the judge was not there and he was not informed of the adjournment.
“Now they are demanding sh40m in damages. Where do they want me to get that money from? Gordon will have to sell my children to recover his money.â€
Contacted, Gordon declined to comment, saying he was not used to cases where someone fights over property that does not belong to him.
