The High Court in Jinja district on Tuesday sentenced two men to life imprisonment for aggravated robbery. The convicts identified as Robert Waiswa alias Angel, 22, and Bosco Mpaata, 23, both matooke sellers, robbed a mother of three children at her home in Mafubira Zone C.
The two were also sentenced to 30 years each for raping the victim and threatening her with a knife. Court presided over by Justice Elizabeth Ibanda Nahamya heard that on May 7, 2009, the two, both residents of Mafubira B, broke into the victim’s house at about 12:00am and demanded money. Testifying in court, the victim said she gave them sh200,000 and a DVD player.
She added that the two then raped her as her 10-year-old son watched. “After pushing me on the bed, Waiswa, who was armed with a knife, raped me first. Mpaata, who is HIV-positive, came next. My husband is never at home. He is a businessman. When came back home and I told him what had happened, he left me,†the victim said.
She added that she recognised Waiswa after the hat he was wearing fell off in the process of raping her. The victim’s son told court he was able to see the thugs because there was a security light illuminating their house.
A security guard said he saw Waiswa and Mpaata hiding near the victim’s house. He added that when he asked them what they were doing there, they threatened to attack him with a knife.
But Mpaata denied the charges, saying he spent that night in a lodge with his girlfriend. In her judgment, Nahamya said: “This behaviour has caused physical and emotional torture to the victim and her son.â€
She added that the two were dangerous to society and should be examples to the youth to prevent them from engaging in such acts.
