Ex-NSSF MD Jamwa sent to Luzira prison

FORMER National Social security Fund (NSSF) managing director David Chandi Jamwa was yesterday remanded to Luzira Prison after his bail was cancelled.

Jamwa is charged with causing a financial loss of over sh2.7b to NSSF, and abuse of office.

The Anti-Corruption Court Chief Magistrate, Irene Akankwasa, committed Jamwa to face trial in the Anti-Corruption High Court division.

Section 168(4) of the Chief Magistrate’s Act states that if the accused is committed to the High Court, his bail lapses.

On Monday, Jamwa’s lawyer, David Mpanga, opposed an application by the Inspector General of Government (IGG) to have his client committed to the High Court, saying the Magistrate’s court could try the offences of causing financial loss and abuse of office.

Mpanga argued that the IGG did not have powers to commit an accused person for trial because such powers were only invested in the Director of Public Prosecutions.

Akankwasa, however, overruled Mpanga and committed Jamwa for trial. The trial date will be set by the Anti-Corruption High Court division.

Prosecution, led by Sydney Asubo from the IGG’s office, said Jamwa abused his office when he arbitrarily sold off several government bonds in Crane Bank before their maturation dates, causing an unfavorable price variance of sh2.7b. The bonds were allegedly purchased on December 14, before their maturation date of November 29, 2007.

Jamwa denied the charges.
Justice John Bosco Katutsi of the Anti-Corruption Court on July 2 granted Jamwa cash bail of sh10m after spending a week in Luzira Prison, following his arrest.

Jamwa was the acting managing director from September 2004 to February 2007 when he was elevated to the position of managing director.
In 2008, he was suspended over his involvement in the sh11.2b Temangalo land deal.

Jamwa’s contract and that of his deputy, Prof. Mondo Kagonyera, expired in February last year and was never renewed.
