THERE was mixed reaction in court on Monday when a judge sentenced a defiler to ‘until court rises’.
This means he completed his jail term at the end of the court proceedings.
The convict, Robert Mutibwa, pleaded guilty to defiling a 16-year-old girl. The accused committed the offence in May 2002 at Mulago in Kampala.
Prosecution said Mutibwa had a long running sexual affair with a girl whom he impregnated. The girl had a miscarriage.
Her parents took the matter to court when Mutibwa refused to assist the pregnant girl.
The accused defended himself, saying he was imprisoned and could not look after the girl.
Passing sentence, Justice Rubby Opio Aweri said the accused and his victim were in the same age bracket when the offence was committed.
“The girl was 16 and the accused was 18. They were working and independent. Considering the above, I sentence you ‘until court rise,” he said. Ends
