COURT yesterday awarded former Nyabushozi County MP Elly Karuhanga sh1.8b for promotional, technical and legal services he offered Swiss Procurement Company South Africa (SWIPCO), reports Hillary Kiirya.

Karuhanga offered SWIPCO the services in 1995 when it won the tender to advise the Government on procurement. The money is to be deducted from what the Government owes SWIPCO S.A. in the deal.

Karuhanga won the case against SWIPCO and was awarded the money but has not been paid todate.

Commercial Court registrar Precious Ngabirano ordered for the payment after Karuhanga applied to court seeking orders for the Government to pay the same.

Karuhanga said he had established that the Government owed SWIPCO money and he would only recover it by court ordering the government to pay him.

Karuhanga sued SWIPCO for a liquidated sum of US$1m plus costs that the ex-MP has been awarded.

The order read, “It is hereby ordered that the applicant be paid the sum claimed.”
It was found that SWIPCO and Karuhanga had dealings which the government was aware of. It also knows that SWIPCO owes Karuhanga money.

“The decree holder is aware that SWIPCO is owed money by Ministry of Finance and Economic Planning, which to my knowledge is sufficient to satisfy the said decree,” said Karuhanga in his application for the award.
