MAJOR General Yusuf Gowon and his two co-accused were yesterday discharged of murder and an alternative count of kidnapping with intent to kill.
Justice Moses Mukiibi set free Gown, Sgt. Nasur Gille and Pte. Mohammed Anyule after prosecution told court that they were no longer interested in the case.
“The Director of Public Prosecution has entered a nolle prosecqui (decision to discontinue prosecution) informing court to discontinue proceedings against Maj. Gen. Yusuf Gowon, Sgt. Gille and Pte. Anyule.
“I hereby discharge the following persons in respect of murder and an alternative count of kidnapping with intent to murder. They should be released immediately from prison unless they are lawfully held for another offense,†said Mukiibi.
The over joyed Gowon and his two colleagues were warmly welcomed by their relatives at the outlet to the prison cells.
Asked by The New Vision how he felt, Gowon retorted, “very excellent.â€
His colleague Anyule could not hide excitement. He shouted praises of President Yoweri Museveni in Swahilli while thumbing up.
Prosecution led by deputy Director of Public Prosecution, Simon Mugenyi Byabakama had alleged that the trio abducted and murdered the former county chief of Ibanda, Eliphaz Laki at Bwizi-Bwera in Mbarara district.
The offense was allegedly committed in September 1972 during the bloody dictatorship of the late Idi Amin.
