By Nathan Etengu Embattled Mbale Town Clerk, Fred Bukeni Ggyabi has contested the Municipality’s decision to interdict him on procedural grounds. He said the indictment was invalid because the council lacked the required quorum. Recently, 16 out of the 25 council members voted for his removal. Bukeni said the resolution would have been valid if 18 councillors had voted in its favour. “I humbly counsel you to seek a legal opinion from your Council lawyer or the Solicitor General as to how the necessary majority is computed under this law. I believe that the 2/3 requirement is of the whole council and not as you are being persuaded to argue,†Bukeni said through his lawyer, Samuel Wegoye. Bukeni is being accused of corruption, nepotism, abuse of office, conflict of interest, among others. Council alleges that in November 2001 he defrauded it of sh4m as commission to Super Star Auctioneers on sh33m the Uganda Land Commission paid to the municipal. Bukeni is also said to have awarded a tender to his company. Bukeni, however, cried foul, saying he was being persecuted. He dismissed the accusations as blatant lies that smirk of politics. “If you’re looking for an accounting officer without queries, then go to heaven,†Bukeni said. He said he should be reinstated as provided by the constitution. “Take notice therefore that if you do seal the false resolution, your council will be held liable for knowingly rubber-stamping a nullity,†the objection notice read. Bukeni formerly worked as deputy chief administrative officer in Mbarara district. The municipality has not yet made an official response. Ends
