Woman, Appeal Court judge fight for child

COURT of Appeal judge Augustine Sebuturo Nshimye has been dragged to court by a woman alleging that he forcefully took away their two-year-old son from her.

COURT of Appeal judge Augustine Sebuturo Nshimye has been dragged to court by a woman alleging that he forcefully took away their two-year-old son from her.
The woman, Anita Akello, wants court to order Nshimye to return the child to her and pay for his maintenance. She said in her affidavit that Nshimye was not staying with the child.
The case is in the Mwanga 11 Magistrate’s Court, which deals with child and family matters.
Akello said as the mother, she was most suitable to care for the child. She said she was staying with the child until January when the judge took him way.
Akello said Nshimye did not have time to attend to the child because of the nature of his job. She, however, added that the judge had the financial capacity to provide the child’s basic needs.
“The welfare of the child demands that custody be granted to the mother who is ready and willing to look after him. The child needs maternal love, care, support and guidance,†Akello said.
Nshimye said Akello had dumped the child at his chambers in at attempt to extort money from him.
He said when he did not give her the money, she threatened to “undress and shout at the top of her voice.â€
Nshimye added that Akello had no time for the child.
He said she usually left home in the morning and returned late at night, leaving the child with the housemaid.
“My wife and children have accepted my son and all love him,†Nshimye said.
The judge added that he had enough time and love for the child.
He said if the child could speak, he would choose to stay with him.
“Besides, Akello is a young woman and is likely to get married,†Nshimye added.
The case resumes on June 22.
