Court halts rent collection in Nakasero market

THE High Court has stopped Nakasero Market Vendors Association from collecting rent from vendors until a case in which they seek implementation of the President’s directive is finally decided.

The vendors, through their lawyer Isaac Walukagga of MMAKS Advocates, said the President had directed that they should be allowed to sub-lease the market.

The court was on Monday told that the vendors association had been collecting rent from the vendors on behalf of the Kampala City Council (KCC).

Justice John Patrick Mashongo Tabaro also ordered the vendors association to open the shops they had closed. The judge adjourned the matter until January 28, 2010 to allow the parties reach an amicable settlement.

Tabaro also advised the two parties that if another problem came up before that date, they should return to court.

Jehoash Ssendege of Ssendege, Sennyondo and Company Advocates, the external lawyers for KCC, represented the Nakasero Market Vendors Association and KCC.

Walukagga submitted that the vendors are seeking orders to nullify KCC’s decision of appointing the vendors association as its agent for collecting rent on the grounds that they disregarded the President’s directive that gives them a chance to sub-lease the market.

The vendors also accused the Nakasero Market Vendors Association of lack of a clear policy of carrying out the work, adding that they acted harshly while collecting the rent.
