THE Masaka High Court judge, Moses Mukiibi, has again rejected a bail application by Kampala tycoon Godfrey Kato Kajubi.
Kato Kajubi is accused of conniving with traditional herbalists, Umar Kateregga and Mariam Nabukeera (Kateregga’s wife), to behead 12-year-old Joseph Kasirye in Masaka last year.
Kajubi first applied for bail in February which application was rejected by Mukiibi on February 17.
Justice Mukiibi, in his ruling, said Kajubi did not produce enough evidence to prove that he was of advanced age.
“You voluntarily told the court that your mother has a mental problem. But at the same time you told this very court that it was that same mother of yours who told you that you were 53 years old,†Mukiibi said, adding that such a mother was not reliable.
Mukiibi said Kajubi had neither complained of overstay on remand nor the State delaying to try him.
The judge also said Kajubi failed to present documents to show he had complicated diseases which necessitated him to get bail.
Kajubi will again appear in court on July 23 for trial. The accused is represented by lawyer Caleb Alaka.
Alaka said the judge had no option but to rule the way he did because his client’s case was up for hearing in the next High Court criminal session.
