The redevelopment of the disputed Plot 39-41 on Ben Kiwanuka Street in Kampala was approved by court recently.

Abdul Kasai of Kanaba Agencies Limited was allowed to redevelop the plot at the edge of the Old Taxi Park in Kampala following a ruling in which the sitting tenants lost a petition seeking to stop their eviction.

In the petition, the tenants had asked Kampala City Council to give them first priority to redevelop the premises.

However, on July 28, a registrar of the High Court, Godfrey Namundi, dismissed the petition.

“It is the view of this court that redevelopment of the said premises adds value to the said premises and the tenants would benefit from an improved working environment,” Namundi said in his ruling.

“The tenants cannot, therefore, claim they will be inconvenienced or suffer irreparable damage,” he added.

Namundi said the tenants should have included KCC as a defendant if they wanted to prove fraud in sub-leasing the plot to Kasai.

He said he had no reason to stop the redevelopment and advised the tenants not to interfere.

In another decree, the chief magistrate of Mengo Court, Margaret Mafabi, on April 22 ordered the tenants to vacate the premises following a civil suit that was filed by Kasai.
