Dad jailed over defiling daughter

PEOPLE filled the courtroom yesterday to have a glance at a man who allegedly sexually abused his 15-year-old daughter. James Kimera, 45, was remanded in Luzira Prison over aggravated defilement, which carries a death sentence on conviction.

He appeared before Buganda Road Court magistrate Susan Kanyange, who did not allow him to plead to the charge.

She explained to Kimera that her court’s responsibility was only to read out the charge and remand him
The Magistrates Court Act was last year amended to enable magistrates try cases of simple defilement involving girls aged 14 to 17.

Under the new act, defilement is divided into simple and aggravated (defiling a girl below 16 years).
Magistrates take charge of the former, while judges handle the latter.

The prosecution led by Emmanuel Ojambo alleged that Kimera, an employee of Speke Hotel, defiled the girl when his wife was admitted in hospital in December.
He committed the offence from his home in Nateete, a Kampala suburb.

The matter was reported to the Police after the victim confided in her elder sister. Ojambo told the court that the investigations into the matter were in the initial stages.
He asked the court to give the Police more time to complete inquiries. Defilement dominates the country’s crime list.

In 2007, defilement cases were 12,230 compared to 15,385 in 2006, Police records showed.
