THE Government has no powers to destroy Mabira Forest Reserve, an environment expert has said.

In an affidavit sworn at the Constitutional Court, Godber Tumushabe of the Advocates Coalition for Development and Environment noted that Article 237 of the Constitution placed the Government as a trustee of the natural resources without powers of destroying them.

He argues that the Government’s action of seeking to degazette the forest constitutes not only a breach of public trust, but is also illegal and against international agreements to which Uganda is a signatory.

Tumushabe said the forest give-away would pose a threat to the environment and deplete the country’s diminishing natural resources.

Five NGOs on Thursday filed a petition seeking a permanent injunction against the Government and the National Forestry Authority from degazetting forest reserves.

They want court to stop the Government from giving Sugar Corporation of Uganda Ltd 7,100 hectares of Mabira forest.
They also want land and natural resources laws harmonised.
