BUVUMA MP William Nsubuga has lost custody of the child he had abducted, the Mwanga II Court has ruled. He is also required to pay costs to the father of the boy.

Court heard that Nsubuga took Ibra Nviri, the son of Isaya Kadhamali, and installed him as heir to his late brother, Charles Mubiru, in 2004.

Nsubuga baptised Nviri, Charles Mubiru, on January 1, 2006 at Namiryango Parish. He then hid him in Luweero district.
The Grade II magistrate, Charles Yeteise, granted Kadhamali custody of his son on Friday after a DNA test proved he was the biological father.

He said court had granted Nviri’s mother reasonable access to her child but on condition that he was supervised by an adult.

Exhibits before court showed that Mubiru, who had wealth estimated at over sh3b, was admitted at Mengo hospital in August 2004. His wife, Marion Mukuye, attended to him.

On August 26, 2004 the two brothers disagreed after Mubiru refused to appoint Nsubuga the director of Mt. Elijah Junior School in Seeta.

Nsubuga claimed he had Mubiru transferred from Mengo to Mulago Hospital for referral treatment.
But when Mukuye got home in Seeta, mourners who told her that her husband had passed away.

Nsubuga produced a death certificate issued by Mengo Hospital on the same day he had Mubiru transferred.
After burial, Mukuye reported the matter to the Police for investigation.

Nsubuga also presented a form from Mulago Hospital showing that the deceased had died before arrival at the hospital.

But Dr. Edward Ddumba, the Mulago hospital executive director denied any record of Mubiru’s death.

A report from the Uganda Funeral Services stated that they were given burial instructions by Hon. William Nsubuga after the body was taken to the Makerere University Medical School’s Department of Anatomy.

A letter from the department showed that Mubiru had died shortly before arrival at the hospital.
