THE Commissioner of Civil Litigation, who is on indefinite interdiction since 2003, has petitioned the Constitutional Court, seeking declaration that his removal from office was unconstitutional.
Cheborion Barishaki also wants the Constitutional Court to declare that his subsequent purported interdiction by the Solicitor General, Lucian Tibaruha (right), as Commissioner of Civil Litigation in the Attorney General's chambers, was a breach of the 1995 Constitution.
Tibaruha removed Barishaki from office on August 25, 2003 and subsequently interdicted him in September 2004, following a directive by the then Minister of Justice and Constitutional Affairs, Janat Mukwaya, on allegations that he misrepresented the State in a constitutional case against it.
