Court clears bypass

THE High Court has overturned an order stopping the construction of the main Northern Bypass roundabout and a fly-over in Bweyogerere.

THE High Court has overturned an order stopping the construction of the main Northern Bypass roundabout and a fly-over in Bweyogerere.
Chief Registrar Masalu Musene accordingly gave the major contractors, Salini Construttori and its sub-contractors, Stirling Civil Engineering Limited and Spencon Services Limited to go ahead with the work until the main application is disposed of.
Last week, court had ordered the contractors to stop the construction on 0.99 hectares of land and vacate the place. Hasbro Investments Limited applied to court for a temporary injunction that was supposed to run up to June 16, which has been overturned.
Bernard Namanya of Barugahare & Company advocates represented Salini in court, saying halting the project would affect them on the deadline. Hasbro, which wanted to construct a factory on the land, is claiming for sh170m but the Government is willing to pay only sh22m.
This is one of the obstacles that the contractors have encountered in the project, that has always forced them to avoid those places and go onto other free places. The Road Agency Formation Unit claimed that all compensations had been completed but has been proved wrong.
After the ruling, Hasbro’s lawyers, James Kyazze of Shonubi, Musoke and Company Advocates, intimated that they would appeal the decision. The main application for the contractors to stop their work has been fixed for June 16.
The joint Uganda-European Union funded project is expected to be completed by July next year.
