By Hillary Kiirya DR Aggrey Kiyingi is involved in a land wrangle with Edith Byanyima over a five-acre piece of land that was allocated to her by Kabaka Ronald Mutebi. According to documents in the High Court’s Land Registry, Kiyingi acquired the land as a kibanja in 2001 from Andrew Luboyera at sh8m. However, the Kabaka in 2005 allocated the land comprising about 20 plots to Byanyima while Kiyingi was on remand in Luzira Prison on murder charges. The land is in Buziga-Munyonyo and each plot goes for sh5m. A September 15, 2005 letter signed by Levi Zimbe, the Secretary to the Buganda land Board, said the Kabaka wanted the land for his developments. It states, “As you are aware, recently unknown people vandalised the fence we had erected around the said two pieces of land which Ssabasajja is going to develop in the very near future. “However, it has been established that after the Kabaka gave the land to Byanyima, she sold it to Kampala businessman Ben Kavuuya of Global Capital Save 2004 Limited.†Byanyima filed a case against Kiyingi seeking a permanent injunction restraining him from trespassing and claiming ownership of the land. A lease document dated September 11, 2002, says Kiyingi still holds the lease that was given to him at sh5m. Byanyima also holds a lease dated April 24, 2006 for a period of 49 years from May 1, 2006 in consideration of a premium of sh10,000 and yearly rent of sh1,000. Both lease agreements were executed by the Kabaka’s attorneys, Aeneas B. K. Ntate and Apollo Nelson Makubuya. Kiyingi placed a caveat on the land on July 19, 2006 and Byanyima also under Rutungi Properties Ltd. placed hers on July 20, 2006 on the same land. Kiyingi is represented by Yusuf Nsibambi, while Byanyima is represented by Geoffrey Nangumya. Ends
