THE High Court recently ordered Kawempe Muslim Secondary School to let a student, Hussein kasekende, sit for his O’Level exams at the school.
The school’s board of governors and the headmaster, however, have asked the court to revoke the September 27 order in the interest of justice.
They said the interim order was wrongly granted on the grounds that at a Parents Teachers Association (PTA) meeting held on December 4, 1993, it was unanimously resolved that any student caught cheating should be made to repeat the class. All parents were signatory to the resolution that was incorporated into the school’s rules and regulations.
The court extended the interim order that was due to expire today. It will now expire on November 3, when the application for a permanent injunction filed by the student against the school will be heard.
Kasekende was demoted to S.3 allegedly for having cheated during internal examinations.
But the school’s BOG had given Kasekende an option to change schools if he wanted to sit for his O’level exams this year and had given him a recommendation to that effect.
But Kasekende filed a suit in the High Court through his father, Al Haji Abubaker Gayinamungu Kasekende, challenging the demotion and sought an injunction restraining the school from stopping him from sitting for his national S.4 examinations.
