Five communication companies are wrestling in court over the ownership of a plot for transmission masts.
MTN Uganda, WBS, Lighthouse Television station and Multi-Choice have jointly disputed Uganda Telecom’s ownership rights of Kololo Summit View hilltop plot where they have transmission masts standing.
Lawyers representing MTN, Multi-Choice, WBS and Lighthouse Television have asked court to dismiss a case in which UTL is seeking eviction of the four companies.
Their lawyers said UTL was not the registered owner of the plot and that it therefore had no right over the plot.
“No where is UTL’s interests registered in the tittle. Whatever interest UTL has in the property has to be registered. But no transfer of the property has been made in favour of UTL,” they said.
But UTL lawyer said his client owned the plot by virtue of having inherited all assets that belonged to Uganda Posts and Telecommunications Corporation.
He said UTL had the certificate of title for the property.
Justice Gideon Tinyinondi said he would rule on the application by MTN and WBS on notice.
In the main suit, UTL sued MTN, Multi-Choice, WBS TV, Lighthouse TV for trespassing on its plot M 27 on Summit View, Kololo.
UTL is also demanding that court orders the demolition of MTN, WBS, Lighthouse and Multi-Choice structures.
Uganda Telecom wants the firms compensate it for the profits they have made by using the plot.
