Kania’s Petition Rejected

The Court of Appeal yesterday dismissed an election petition appeal by the Terego county polls loser, Obiga Kania.

By Hillary NsambuThe Court of Appeal yesterday dismissed an election petition appeal by the Terego county polls loser, Obiga Kania.The court said the appeal lacked merit.Kania had requested the court to overrule the High Court decision to uphold the election of Kassiano Wadri Ezati. Justices Alice Mpagi-Bahigeine, Joseph Patrick Berko and Amos Twinomujuni concurred that the trial judge, Robby Aweri Opio, was right when he found that there was no case in the petition. They rejected Kania’s grounds of appeal, saying although he was careless with his nomination, the grounds on which it was challenged could not warrant court to annul it. The justices ruled that the Arua Returning Officer did not commit any offence.Ends
