CBS employees ask court to hear their case

LAWYERS representing employees of Central Broadcasting Corporation (CBS) radio have asked the High Court to set a date for the hearing of the sh3b case against the State, saying the Attorney General (AG) has failed to file his appeal.

The AG, Khiddu Makubuya, appealed against a ruling which dismissed the Government’s counter-claim, asking the employees to compensate people who lost property during the September uprising.

Riots rocked Kampala when the Buganda premier was barred from going to Kayunga in Bugerere county to prepare for the Kabaka’s visit.

“As a matter of urgency, we request that this suit be fixed for hearing without unnecessary delay,” read a letter written to the deputy registrar of the High Court’s civil division.

The January 31 letter argued that since October last year, when the court granted the AG permission to appeal against the dismissal of the state’s counter-claim, no grounds of appeal or notice of appeal had been filed.

“Our clients have waited too long after suffering for over one year when the radio was closed,” the lawyer said.

In 2009, over 100 CBS employees, sued the Government for unjustifiably closing down the station and depriving them of employment and earnings. They are seeking to recover sh3b in damages as compensation.

John Katende, one of the lawyers, on Monday told New Vision that legally, the time had run out for the AG to file the appeal.

When the AG sought permission to appeal against court’s ruling and it was granted, CBS’s lawyers objected, saying the Government’s counter-claim was bad in law and should have been rejected.

The lawyers argued that the AG’s appeal was aimed at delaying the hearing of the main suit.
