Rubaga North parliamentary candidate in the February 18 elections Moses Kasibante yesterday told court that he was convinced that he won the seat, and not Singh Katongole.

Kasibante was under cross-examination by Simon Tendo Kabenge, one of Katongole’s lawyers, over allegations that recounting the votes robbed him of his victory.

In the petition, Kasibante alleges that the Electoral Commission (EC) and Katongole connived to rob him of his victory through an illegal vote recount.

Kasibante told court that the EC initially declared him winner on February 2o this year with 24,054 votes against Katongole’s 18,595 votes. Seven other candidates took part on the race.

However, Kasibante said when the former Mengo Chief Magistrate, Phillip Odoch, ordered the recount of the votes, Katongole was declared winner with 24,802 and he (Kasibante) came second with 22,850.

Kabenge wondered why Kasibante petitioned court, yet he was the pronounced winner in 134 polling stations out of the 141 polling stations.

Kasibante, however, conceded that he was declared winner before results from all the 141 polling stations had been tallied.

Dr. James Akampumuza, another of Katongole’s lawyers, who cross-examined Kasibante for the entire afternoon, apologised to the court when the trial judge, Vincent Musoke Kibuuka, intervened and asked Kasibante not to answer a question that concerned law.

Kasibante was represented by Medard Lubega Ssegona and Abdallah Kiwanuka.

Akampumuza continues with his cross examination today.
