BUGANDA Road Court yesterday issued criminal summons for city businessman Hassan Basajjabalaba in relation to the alleged assault of New Vision photographer Arthur Kintu.

He is expected to appear in court on July 27.

Senior Grade One Magistrate Evans Palodi advised Basajjabalaba to appear in court to explore the option of reaching an amicable settlement before the actual hearing starts.

Prosecution, led by Patricia Cingtho, said Basajjabalaba, during the NRM primaries on September 6, 2010 at Mandela National Stadium in Wakiso district, unlawfully assaulted Kintu and occasioned bodily harm on him.

Kintu, who was accredited to cover the function, was taking photographs of Basajjabalaba, who had just been voted as the head of the entrepreneurs’ league, when the businessman is said to have slapped and punched him.

Hearing of the case had been scheduled to begin yesterday, but Basajjabalaba’s lawyer, Denis Byaruhanga, informed court that he (Basajjabalaba) was away in Dubai for a medical check-up.

Earlier, the magistrate inquired whether the two parties had attempted to explore the option of an out-of-court settlement. But Kintu reported that Basajjabalaba had continued to be hostile, and had again threatened to “break his nose”.

Palodi said court would not tolerate such a barbaric attitude and asked Basajjabalaba’s lawyer to calm him down. “Let your man cool down and stop being arrogant. Meet and find a way to solve this,” he said.

Kintu was represented by Vision Group legal officer John Mugalula.
