Police have transfered a Kampala businessman Godfrey Kato Kajubi to Masaka court to face fresh murder chrages.

This after the Director of Public Prosecution (DPP) Richard Butera directed on Monday to transfer Kajubi to Masaka where he is alleged to have committed the crime.

Police working on a tip off  over the weekend rearrested ajubi in connection with the 2008 murder of 12 year old Joseph Kasirye.

Kajubi, who has been on the run for over year, was arrested from a Shrine in Lweza A Zone, near Kajjansi on the outskirts of the city. By press time yesterday, he was still detained at Kajjansi police station.Police spokesperson Asuman Mugenyi confirmed the arrest.

“At about midday, he arrived at a shrine in Lweza A and we got a tip and arrested him,” Police spokesman Asuman Mugenyi said yesterday.

In November 2010, the Court of Appeal ordered that Kajubi must be retried on murder charges after the State appealed against his acquittal.

Immediately after the Court of Appeal had ordered that he should be re-arrested and retried before another judge, Kajubi  went to the Supreme Court to block the order for re-arrest saying that he had filed a notice of appeal in court, showing that he intended to file a substantive appeal later.

However, the Supreme Court rejected his application saying that Kajubi should not hide behind a notice of appeal to evade arrest and face the retrial.

In his appeal challenging Kajubi’s acquittal, the DPP had asked the Court of Appeal to either put Kajubi straight on his defence or, alternatively, order his retrial before another judge.
